Do trusts have a future?

Trusts are still the best form of asset protection and estate planning available to us and our families. If a trustee does their job well, and gets the right advice all the way through, no harm should come to them. Get it wrong though.....!

In a recent court case, a trustee faced bankruptcy because, as a trustee, they signed a loan agreement with no limitation of liability clause in it. This meant that when the Trust failed to meet the loan payments, the trustee became personally liable. In another case, there was a limitation of liability, and the trustee was protected.

Getting the right advice is always important when dealing with trusts. One lesson we have all learned from the court cases over recent years is that the key to a sound trust is proper administration and proper and prudent decision making on the part of trustees.
